Regulations on the sale and reservation of tickets and subscriptions in force at the Józef Wiłkomirski Sudeten Philharmonic in Wałbrzych with the rules for the audience in the concert hall

§1 Definitions and general provisions

1. These Regulations for the sale and reservation of tickets applicable at the Józef Wiłkomirski Sudeten Philharmonic in Wałbrzych and the rules for the audience in the concert hall (hereinafter referred to as the Regulations) specify the rules for the sale, reservation and return of tickets for events organized by the Józefa Wiłkomirski Sudeten Philharmonic in Wałbrzych and the rules for the audience in the concert hall.

2. Formal and legal data: Józef Wiłkomirski Sudeten Philharmonic, ul. Juliusza Słowackiego 4, 58-300 in Wałbrzych, managed by the Lower Silesian Voivodeship Government, entered into the Register of Cultural Institutions under number 13/1999 on September 24, 1999, REGON: 000786756 VAT No.: 886 000 39 76.

3. For the purposes of the Regulations:
“event” – means concerts and other forms of statutory activity organized by the Józef Wiłkomirski Sudeten Philharmonic in Wałbrzych (hereinafter referred to as the “Philharmonic”),
“external event” should be understood as an event taking place at the Philharmonic, but organized by an external organizer,
“special concert” should be understood as a concert organized by the Philharmonic, for which ticket prices have been set individually,
“subscription” means a subscription ticket entitling to participate in subscription concerts organized by the Philharmonic,
“ordering party” means the person placing the order,
“box office” – whenever the Regulations refer to the Philharmonic Box Office, it means the ticket office located at the venue of the Sudeten Philharmonic, ul. Juliusza Słowackiego 4A, Wałbrzych.
“passes” – means a ticket for selected events organized by the Philharmonic or in which the Philharmonic is a co-organizer.

4. Information about the current opening hours of the box office and changes to the opening hours of the box office is available on the website www.filharmoniasudecka.pl/en in the Contact tab and in the Tickets/General Information tab, as well as posted on the entrance door of the Sudeten Philharmonic at 4A Juliusza Słowackiego Street in Wałbrzych.


§ 2 Ticket reservation

1. Tickets for events organized by the Philharmonic can be reserved (only in the case of organized groups, i.e. no less than 10 people) in person at the box office and by e-mail to biuro@filharmoniasudecka.pl.

2. A reservation made via e-mail is considered effective when the Ordering Party receives feedback and its confirmation by the box office employee.

3. When reserving tickets, please provide the following information:
– date, title and time of the selected event
– number of tickets ordered
– name and surname of the ordering party
– telephone number
– e-mail address
– VAT invoice data if the ordering party wants to receive an invoice.

4. By making a reservation the ordering party accepts these Regulations and commits to their application as well as consenting to be contacted by the Philharmonic in order to effectively handle the reservation in the event of any changes in the repertoire.

5. The reservation is temporary and is valid for 3 days from the moment of making it, but no longer than two days before the start date of the event.

6. After the deadline indicated in point 5, unpaid reservations are cancelled and put up for sale.

7. A paid reservation becomes a ticket when the funds are transferred to the Philharmonic’s bank account indicated in point 8 (and accordingly when the payment is made at the Philharmonic Box Office in the case of a reservation for an organized group) – while maintaining the deadline referred to in point 5 and entitles the ordering party to collect tickets for the event:
a) after presenting proof of payment at the box office within the reservation validity period (point 5) during the box office’s opening hours
b) after sending confirmation of the transfer to the following address: sklep@filharmoniasudecka.pl and after receiving confirmation of receipt of an e-mail from the box office employee. Such a confirmed ticket must be collected no later than 30 minutes before the start of the event.

9. The transfer title should include: name and surname of the person making the reservation, date and time of the event, number and types of tickets and the reservation number sent in the e-mail confirming the reservation.

10. On the day of the concert, priority when purchasing tickets is given to people who buy a ticket for the concert taking place on that day.

11. The Philharmonic reserves the right to introduce separate rules for booking tickets for selected events as part of special price promotions, determined individually.

12. The Philharmonic box office does not run reservations of tickets for external events.

§ 3 Ticket sales

1. Tickets for events are sold in person at the box office of the Sudeten Philharmonic and online via the website www.filharmoniasudecka.pl and https://bilety.filharmoniasudecka.pl

2. Tickets to the Sudeten Philharmonic may be sold in the form of online sales, which means that the Buyer makes the purchase independently via the website: https://bilety.filharmoniasudecka.pl

3. In the case of online sales, the rules of the Przelewy24 website Regulations available at przelewy24.pl apply.

4. The purchase of a ticket constitutes the Buyer’s acceptance of these Regulations.

5. The Philharmonic Box Office does not sell tickets for external events.

6. The Buyer is obliged to check the tickets immediately after purchasing them to ensure that the date and time of the event and the number and price of tickets are correct. Complaints submitted after leaving the checkout will not be accepted.

7. The available form of payment at the Philharmonic Box Office is cash or payment card.

8. The Philharmonic is not responsible for any interruptions in the processing of payment card payments caused by the system operator.

9. The Philharmonic does not ship or deliver tickets purchased at the ticket office.

10. At the Buyer’s request, purchased tickets for the event may be transferred to an invitation form at the Philharmonic Box Office, and such requests are accepted no later than the day before the event. The purchased tickets then remain in the box office’s settlement records.

11. Proof of sale is a ticket printed by the system, which should include: date, time and name of the organized event, row and place as well as price. Each ticket printed by the sales system is equipped with a unique barcode. Together with the ticket, the Buyer receives a receipt from the cash register, which they are obliged to keep in the case when a ticket return must be made.

12. A ticket that is illegible, destroyed or damaged does not entitle you to entry to the event. The Philharmonic is not responsible for damaged or lost tickets.

13. Ticket prices are regulated by the Price List available at the Philharmonic Box Office and on the website, all prices are given in Polish zlotys and include VAT.

14. The Philharmonic reserves the right to introduce separate rules for the sale of tickets for selected events as part of special price promotions, determined individually.

15. In order to receive an invoice for tickets purchased at the Philharmonic Box Office, please notify the seller before purchasing the ticket and provide the correct data necessary to issue the invoice.

16. The Sudeten Philharmonic sells tickets online at https://bilety.filharmoniasudecka.pl.

17. By placing an order and paying the price, the Ordering Party concludes an agreement with the Sudeten Philharmonic to provide services related to cultural events, which is confirmed by the ordered ticket.

18. The Ordering Party placing the order is obliged to select the event, the date of the event, the type and number of tickets, the payment method and read the Ticket Sales Regulations.

19. In the case of an order placed via the website https://bilety.filharmoniasudecka.pl , the Ordering Party shall be requested to provide the Ordering Party’s personal data and to consent to the processing of their personal data by the Sudeten Philharmonic on the terms specified in the GDPR information clause available at the ticket office and on the website https://filharmoniasudecka.pl/en/gdpr/.

20. After placing the order, the Ordering Party shall receive an order confirmation by e-mail to the e-mail address provided by the Ordering Party.

21. The ordering party is obliged to pay the ticket price immediately after placing the order.

22. The Sudeten Philharmonic reserves the right to a limited number of tickets being available for promotional sale until the tickets covered by this form of sale are exhausted or until the promotion end date set by the Sudeten Philharmonic expires.

23. An invoice is issued for each order at the request of the Ordering Party. In order to receive an invoice, the Ordering Party is obliged to provide invoice data during the ticket purchase process.

24. Online transactions are processed through the entity providing electronic transfers, PayPro S.A. and the Przelewy24 payment service.

§ 4 Forms of payment

1. Available payment methods: fast electronic transfer (supported by Przelewy24), bank transfer, payment card (supported by Przelewy24).

2. The online ticket sales website of the Sudeten Philharmonic: sklep.filharmoniasudecka.pl does not offer the “cash on delivery” payment method. Payment on delivery – in cash, is only possible in the case of personal purchase of tickets at the Sudeten Philharmonic Box Office during the opening hours of the Sudeten Philharmonic Box Office given in the Contact and Tickets/General Information tabs on the website www.filharmoniasudecka.pl/en.

3. At the request of the purchaser of tickets paid by electronic transfer via the Przelewy24 payment service, the Sudeten Philharmonic is obliged to issue an invoice documenting the transaction if the request for its issuance was submitted during the purchasing process. The invoice is generated electronically.

§ 5 Types of tickets and discounts

1. The Sudeten Philharmonic offers regular tickets, reduced tickets, VIP tickets and subscriptions, the prices of which are given in the Price List available at the box office and on the Philharmonic website.

2. Reduced tickets are available to:
Reduced tickets are available to retirees, pensioners, school kids studying full-time, students up to 26 years of age, people with a disability certificate, the guardian of a person with a disability certificate, people with a “I love Wałbrzych” – Wałbrzych Resident Card, organized groups of minimum 20 people and to persons holding a Sudeten Philharmonic Music Pass obtained on the basis of concluded cooperation agreements.
Special reduced tickets in the amount introduced by a decision of the director of the Sudeten Philharmonic are available to: holders of the Walbrzych Foster Family Card, Big Family Card and students of music schools from Lower Silesia for concerts indicated by a decision of the director of the Sudeten Philharmonic.

3. Children up to 3 years of age are admitted with their guardian on his or her ticket (one seat), however, there can be one child of the above-mentioned age per guardian.

4. The document entitling you to the discount must be presented before entering the concert hall.

5. Persons who have purchased reduced tickets and do not have a valid document entitling them to the discount are obliged to report to the Box Office to pay the balance for a regular ticket, otherwise they will not be allowed to enter the concert hall.

§ 6 Failure of the ticket sales and reservation system

1. In the event of a sudden failure of the Sales System, the Philharmonic suspends the reservation and sale of tickets until the System failure is fixed. Only people who have a ticket entitling them to participate in the event are admitted to the event.

2. The Philharmonic is not liable for any damage resulting from the failure referred to in section 1, and in particular it is not obliged to refund any costs incurred in connection with arriving at the event.


§ 7 Rules for the audience

1. Events start on time, and therefore listeners are obliged to arrive at the Philharmonic well in advance. After the event begins, latecomers will not be allowed into the concert hall until the intermission if an intermission is included in the event programme. If there is no intermission, latecomers will not be admitted. In such a case, the ticket is non-refundable.

2. The ticket is subject to one-time verification upon entry to the event; a person holding a discount ticket is obliged to present a document entitling them to a discount upon request of a service employee. If you do not have such a document, you will be asked to go to the ticket office to pay the balance for the regular ticket.

3. It is forbidden to bring or consume any food or drinks in the audience.

4. The use of tobacco and tobacco products outside the designated areas is prohibited on the premises of the Philharmonic.

5. Service staff have the right to refuse entry to the auditorium to persons under the influence of alcohol or other intoxicants.

6. Listeners are obliged to occupy the seats specified on the admission ticket unless they are informed otherwise by the audience staff.

7. There are no age restrictions for events organized by the Philharmonic, however, if a child’s behavior makes it difficult for other listeners to participate in the event, the guardian may be asked by the staff to leave the hall with the child. In such a case, the ticket is non-refundable.

8. The Philharmonic reserves the right to refuse entry to the ticket holder in cases justified by security reasons and to demand, in cases justified by security reasons, that the ticket holder leaves the event premises and to take appropriate steps. This applies in particular to situations in which the participant disrupts order, behaves aggressively or inconsistently with these Regulations.

9. By participating in an event organized by the Philharmonic the Participant consents to free recording of his/her image (in particular photography, filming) during his/her stay at the place and time of the event, and in particular during the event itself. The consent covers the use of the image in the Philharmonic’s materials for promotional, archival and information purposes. Lack of consent should be reported to biuro@filharmoniasudecka.pl

10. Baby strollers/prams are not allowed into the auditorium.

11. It is prohibited for listeners to record events (photographing, filming, sound recording). Recording events by accredited media requires the prior consent of the Director of the Philharmonic.

12. During the events, the use of mobile phones is prohibited, and it is obligatory to turn them off, as well as to turn off sound signals in other electronic devices.

§ 8 Returns

1. If the Philharmonic cancels the event, it undertakes to refund the price for the purchased ticket. In the event of a change in the date or place of the concert, the Philharmonic undertakes to refund the price for the purchased ticket at the request of its purchaser. In this case, the basis for a refund for the purchased ticket is to have a valid ticket together with a fiscal receipt or, when making an electronic payment, confirmation of the online payment transaction via the Przelewy24.

2. In cases other than those described in point 1, ticket returns are not possible.

3. Refunds are made in the same form in which the payment for the tickets was made.

4. The Philharmonic is not responsible for external events (organized at its premises by external organizers) for which tickets are not sold through the Philharmonic’s sales system. In such a case, ticket refunds and all other benefits to event participants are provided by the direct organizer of the event.

§ 9 Complaints

    The Ordering Party has the right to submit a written complaint sent to the following address: bilety@filharmoniasudecka.pl. Complaints are considered within 14 days from the date of receipt of the complaint at the latest. If the complaint is accepted, the Sudeten Philharmonic shall immediately refund the Ordering Party the equivalent of the ticket price paid or offer another option – at the Ordering Party’s choice.

    § 10 Final provisions

    1. These Regulations for reservations and purchasing of tickets are available on the website www.filharmoniasudecka.pl/en and at the Philharmonic Box Office.

      2. Information on the repertoire and ticket prices is available on the Philharmonic website.

      3. Subject to the provisions of § 8, the Philharmonic reserves the right to change the repertoire.

      4. The Philharmonic reserves the right to conduct and cancel promotional campaigns.

      5. The Philharmonic reserves the right not to refund transport costs incurred in the event of cancellation of a performance for reasons beyond its control, such as, among others: national mourning, artist’s illness, unfavourable weather conditions, etc.

      6. In matters not covered by these regulations, the provisions of Polish law shall apply, in particular the Civil Code, the Act on Consumer Rights and the provisions of the Act on the provision of electronic services.
